The Board noted the explanation of Jockey Habib, has adjourned to confirm the above instructions with Assistant Trainer Forster and advised Jockey Habib that should he be instructed and/or elect to ride in a similar manner in future, the Stipendiary Board must be notified. In the pull-up, Jockey Moodley was forced to dismount from TUPELO HONEY due to the saddle having slipped back severely. Jockey Moodley signed an admission of guilt for a contravention, read in conjunction with Guideline M, in that he struck the horse TUPELO HONEY more than 12 times in the entire Race. In deciding what penalty to impose, the Board considered Jockey Moodley's recent record in relation to this Rule, the manner in which he used his crop and the number of times that he struck TUPELO HONEY. Accordingly, a penalty was imposed. Additionally, Jockey Moodley was advised that should he appear before the Board regarding a similar contravention in future, a more severe penalty may be imposed.
