In deciding what action to take against Jockey Schwarz, the Board considered the number of times Jockey Schwarz struck the horse RAILTRIP, the distance over which and manner in which, Jockey Schwarz used his crop and his record in relation to this Rule. Accordingly, a penalty of a fine was imposed. Jockey Moodley signed an admission of guilt for a contravention, read in conjunction with Guideline M, in that he struck TECHNO CAPTAIN more than 12 times in the entire race. In deciding what action to take against Jockey Moodley, the Board considered the number of times Jockey Moodley struck the horse TECHNO CAPTAIN, the distance over which and manner in which, Jockey Moodley used his crop, the fact that he won the race and his record in relation to this Rule.
