LA DUCHESSE reared as the start was effected losing 3 lengths. Trainer Gadsby to be advised to re-school this filly. In deciding what action to take against this filly, the Board considered her non-history at the starting stalls. A race review was called into the start of this race. In this regard, it was established that whilst LA DUCHESSE who was in stall gate 11, jumped slowly, she was not impeded by the Handler nor had she jumped slowly due to any fault of the starting stalls. Therefore, any loss of distance suffered by this filly was due to her own behaviour. Consequently, the Board deemed LA DUCHESSE to be a runner. AIDEEN was selected for the taking of specimens for analysis. Prior to the commencement of this race meeting, Jockey Marcus approached the Stipendiary Board and confirmed that his riding instructions on LA DUCHESSE in Race 5 was to, if the circumstances permit, ride this filly cold. Assistant Trainer Miss Crawford appeared before the Board and was questioned regarding the improved performance of AIDEEN. In this regard, she was unable to provide a suitable explanation for the improved performance of AIDEEN. Consequently, Miss Crawford's attention was drawn to the Rules pertaining to "in and out" running and she was advised that this filly's performances would be monitored going forward. TAROCCO over-raced in the early and middle stages. In the concluding stages, ALABAMA SLIDE had to switch out to continue her run when awkwardly placed on the inside of LA DUCHESSE who had come to the end of her run and shifted in when tiring. Jockey Marcus signed an admission of guilt for a contravention, read in conjunction with Guideline M, in that whilst riding LA DUCHESSE, he used his crop more than 12 times in this race. In coming to a suitable penalty the Board considered the manner in which the crop was used as well as Jockey Marcus' record and fined him.
